They should check their current reporting status and ongoing responsibilities, rather than waiting for INSQUI to be set up. In Colombia, there&#8217;s a rule that says companies making or bringing in hazardous chemicals have to report what they&#8217;re doing. This rule, called INSQUI, applies to manufacturers and importers who handle more than 100 kg of these chemicals per year. But there are some exceptions to this rule. When it comes to evaluating substances, it&#8217;s not just about looking at individual substances, but also at those that are mixed with other things. So, companies that bring in products that are already put together should take a closer look at the chemicals that make up those products and how much of each they use every year. They can&#8217;t just focus on the total weight of the final product. Annual quantities manufactured or imported. Any applicable exclusions. Which Substances Are Covered or Exempt? The framework in this regulation refers to industrial chemical substances that are classified as hazardous under the GHS for which a regulation is being developed in Colombia. Substances excluded from this regulation are referred to in Decree 1630 of 2021. These include: Substances subject to specific regulations for their use. Substances of unknown or variable composition, complex reaction products or biological materials (UVCBs). Articles and impurities. Naturally occurring substances without chemical processing. c) Certain substances that have been exposed to the environment, stored, used as the final product or have undergone chemical reactions, etc. By-products not imported or marketed as such. Hydrates and hydrated ions. Polymers, including the monomeric units and the additives that are part of these polymers. Substances in customs transit. Non-isolated intermediates. Samples without commercial value. Note that whether an exemption also means an obligation under other legislation regarding chemicals or products depends on the respective substance, its use and other circumstances. For instance, the exemption of polymers shall not automatically extend to the respective separately supplied monomers. What Information Is Required for INSQUI Reporting? You report through the on-line system INSQUI (Spanish language) managed by the Ministry of Commerce, Industry and Tourism. What Are the Annual Reporting Deadlines? The initial reporting period for the inventory has come to an end. The annual updates and any reports for newly introduced substances have to be handled by the manufacturers and importers.
