Se espera que el ICMSR se notifique a la OMC en 2022 y entre en vigor tras un proceso de examen jur\u00eddico y comentarios ministeriales.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ff363ba elementor-widget elementor-widget-heading\" data-id=\"ff363ba\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">\u00bfA qui\u00e9n concierne?<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1a82fa8 elementor-widget elementor-widget-text-editor\" data-id=\"1a82fa8\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul><li><p>Los fabricantes e importadores indios est\u00e1n obligados a cumplir el ICMSR, que tambi\u00e9n contiene algunas obligaciones para los usuarios intermedios.\u00a0<\/p><\/li><li><p>Las entidades extranjeras que deseen colocar productos en el mercado indio deben designar a un Representante Autorizado (RA) para que act\u00fae y cumpla con el ICMSR en su nombre.<\/p><\/li><li><p>La notificaci\u00f3n es obligatoria para todas las sustancias en cantidad superior a 1 tonelada al a\u00f1o (TPA). Adem\u00e1s, solo es necesario registrar las sustancias que figuran en la lista de \"Sustancias prioritarias que deben registrarse\" de la Lista II del ICMSR.<\/p><\/li><\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c4027f1 elementor-widget elementor-widget-heading\" data-id=\"c4027f1\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">\u00bfCu\u00e1les son las principales obligaciones del ICMSR?<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7c1cc39 elementor-widget elementor-widget-heading\" data-id=\"7c1cc39\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Notificaci\u00f3n<\/h4>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-da03a11 elementor-widget elementor-widget-text-editor\" data-id=\"da03a11\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Se requiere notificaci\u00f3n para todas las sustancias colocadas en territorio indio en cantidades superiores a 1 TPA.\u00a0<\/p><p>El ICMSR incluir\u00e1 un periodo de notificaci\u00f3n inicial (INP) en el que los fabricantes, importadores y representantes autorizados deber\u00e1n notificar sus sustancias. El proyecto actual prev\u00e9 un PNA de 180 d\u00edas, a contar desde la entrada en vigor del ICMSR. Las sustancias notificadas durante el PNA se considerar\u00e1n sustancias existentes.\u00a0<\/p><p>Las sustancias no notificadas durante el INP se considerar\u00e1n Nuevas Sustancias. Si se comercializan en el mercado indio en cantidades superiores a 1 TPA, deber\u00e1n notificarse al menos 60 d\u00edas antes de su comercializaci\u00f3n en territorio indio.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ddf09c4 elementor-widget elementor-widget-heading\" data-id=\"ddf09c4\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Inscripci\u00f3n<\/h4>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f223b40 elementor-widget elementor-widget-text-editor\" data-id=\"f223b40\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Adem\u00e1s de la Notificaci\u00f3n, algunas sustancias requerir\u00e1n Registro si se encuentran en territorio indio en cantidades superiores a 1 TPA. Estas sustancias tambi\u00e9n requerir\u00e1n Registro cuando est\u00e9n presentes en art\u00edculos a partir de los cuales se pretende o es probable que se liberen en cantidades superiores a 1 tonelada por productor o importador y a\u00f1o.\u00a0<\/p><p>El ICMSR adopta un enfoque de lista para el registro. Todas las sustancias incluidas en la Lista II deben registrarse en los 18 meses siguientes a su inclusi\u00f3n en la Lista.\u00a0<\/p><p>Los productos intermedios -sustancias que se fabrican, consumen o utilizan en procesos qu\u00edmicos para ser transformadas en otras sustancias- tambi\u00e9n incurren en obligaciones de registro, que var\u00edan en funci\u00f3n de su cantidad y de si se almacenan o transportan.\u00a0<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f914748 elementor-widget elementor-widget-heading\" data-id=\"f914748\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Informes<\/h4>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b3f8d67 elementor-widget elementor-widget-text-editor\" data-id=\"b3f8d67\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul><li><p>La informaci\u00f3n presentada en el momento de la Notificaci\u00f3n y el Registro debe actualizarse peri\u00f3dicamente.\u00a0<\/p><\/li><li><p>Debe elaborarse un informe anual para todas las sustancias notificadas durante los primeros 60 d\u00edas del a\u00f1o natural. Este informe debe incluir cualquier cambio en la informaci\u00f3n presentada en el momento de la notificaci\u00f3n, as\u00ed como la cantidad real de sustancias depositadas en territorio indio (incluidos los cambios aplicables en las tasas).\u00a0<\/p><\/li><li><p>Los cambios en la informaci\u00f3n presentada en el momento de un registro deben notificarse, si afectan a la gesti\u00f3n de peligros o riesgos, en el plazo de 60 d\u00edas desde que el solicitante de registro tenga conocimiento de los cambios.\u00a0<\/p><\/li><\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-da88cf5 elementor-widget elementor-widget-heading\" data-id=\"da88cf5\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Estrategias de cumplimiento<\/h4>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div un inventario de las sustancias que se manipulan<\/p><\/li><li><p>Identificar la cantidad colocada en la India<\/p><\/li><li><p>Iniciar la comunicaci\u00f3n con los usuarios intermedios<\/p><\/li><li><p>Actualizar la FDS de acuerdo con el SGA Rev. 8<\/p><\/li><li><p>Mant\u00e9ngase al d\u00eda sobre el ICMSR<\/p><\/li><li><p>Organizar actividades de formaci\u00f3n interna sobre el ICMSR<\/p><\/li><li>Seguimiento de las Listas pertinentes de la lista de sustancias del ICMSR: Sustancias que deben registrarse (Lista II), Sustancias restringidas o prohibidas (Lista VI) y The ICMSR is expected to be notified to WTO in 2022 and come into force after a process of legal vetting and ministerial feedback. Who is concerned? Indian manufacturers and importers are required to comply with the ICMSR, which also contains some obligations for Downstream Users.\u00a0 Foreign entities wishing to place products in the Indian market should appoint an Authorized Representative (AR) to act and comply with the ICMSR on their behalf. Notification is required for all substances that are in quantity above 1 Tonne Per Annum (TPA). Additionally, only substances that are listed in \u201cPriority Substances Required to be Registered\u201d in Schedule II of the ICMSR need to be registered. What are the main obligations under ICMSR? Notification Notification is required for all substances placed in Indian Territory in quantities above 1 TPA.\u00a0 The ICMSR will include an Initial Notification Period (INP) where manufacturers, importers and Authorised Representatives should notify their substances. The current Draft provides for an INP of 180 days, counting from the entry into force of the ICMSR. Substances notified during the INP will be considered Existing Substances.\u00a0 Substances not notified during the INP will be considered as New Substances. If placed in the Indian market in quantities above 1 TPA, they must be notified at least 60 days prior to being placed in Indian Territory. Registration In addition to Notification, some substances will require Registration if placed in Indian Territory in quantities above 1 TPA. These substances will also require Registration when present in Articles from which they are intended or likely to be released in quantities greater than 1 tonne per producer or importer and year.\u00a0 The ICMSR adopts a listing approach to Registration.
