Sin embargo, no hay ninguna ley aplicable a los productos qu\u00edmicos industriales. En octubre de 2018, la Comisi\u00f3n Nacional de Seguridad de los Productos Qu\u00edmicos\u00a0<a href=\"https:\/\/conselhos.cut.org.br\/conselhos\/comissao-nacional-de-seguranca-quimica\/\" target=\"_blanck\" rel=\"noopener\">(Comit\u00ea Nacional Sobre Seguran\u00e7a Qu\u00edmica, o CONASQ),\u00a0<\/a>junto con el Ministerio de Medio Ambiente (Minist\u00e9rio do Meio Ambiente, o MME), public\u00f3 un Anteproyecto de Ley de Inventario, Evaluaci\u00f3n y Control de Sustancias Qu\u00edmicas.<\/p><p>El proyecto de ley establece disposiciones para la creaci\u00f3n de un inventario nacional de sustancias qu\u00edmicas existentes y para la evaluaci\u00f3n y el control de las sustancias qu\u00edmicas. El proyecto de ley 6120\/2019 obligar\u00eda a los fabricantes, exportadores e importadores de sustancias qu\u00edmicas a informar sobre el volumen de sustancias qu\u00edmicas producidas e importadas anualmente. Adem\u00e1s, las Fichas de Datos de Seguridad (FDS) tendr\u00edan que prepararse de acuerdo con el SGA, incluyendo los usos recomendados, las clasificaciones de peligro y los estudios de an\u00e1lisis de evaluaci\u00f3n de riesgos qu\u00edmicos para los usos recomendados. El proyecto de ley fue aprobado por el Comit\u00e9 de Desarrollo Econ\u00f3mico, Industria, Comercio y Servicios Comerciales (CDEICS) el 23 de noviembre de 2022. Ahora la medida est\u00e1 siendo examinada por la Comisi\u00f3n de Constituci\u00f3n, Justicia y Ciudadan\u00eda (CCJC). \u00a0<\/span><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5a56437 elementor-widget elementor-widget-text-editor\" data-id=\"5a56437\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Los aspectos m\u00e1s importantes del Proyecto de Ley 6120\/2019 son:<\/p><ul><li>Los requisitos de datos de notificaci\u00f3n incluyen la identidad de la sustancia, el n\u00famero CAS, los usos recomendados, la ficha de datos de seguridad, la informaci\u00f3n de clasificaci\u00f3n y el an\u00e1lisis de evaluaci\u00f3n de riesgos para todas las sustancias del Cat\u00e1logo.<\/li><li>El proyecto de ley adopta el SGA como sistema de clasificaci\u00f3n obligatorio.<\/li><li>Los datos relacionados con el peligro y el riesgo no son confidenciales, pero la identidad de la sustancia puede serlo en circunstancias especiales.<\/li><li>Los productos qu\u00edmicos de composici\u00f3n desconocida o variable (UVBC) deben registrarse como un \u00fanico producto qu\u00edmico.<\/li><li>Las sustancias candidatas a ser prioritarias son las carcin\u00f3genas, mut\u00e1genas y reprot\u00f3xicas (CMR), las persistentes, bioacumulativas y t\u00f3xicas (PBT) y los alteradores endocrinos. Adem\u00e1s, tambi\u00e9n pueden priorizarse las sustancias cubiertas por acuerdos o convenios internacionales.<\/li><li>Los fabricantes, exportadores e importadores de sustancias qu\u00edmicas est\u00e1n obligados a facilitar informaci\u00f3n al Inventario Nacional de Sustancias Qu\u00edmicas.<\/li><li>Los ensayos con animales deben ser el \u00faltimo recurso para determinar la peligrosidad de una sustancia qu\u00edmica.<\/li><li>El incumplimiento de la ley est\u00e1 sujeto a sanciones administrativas.<\/li><li>El Gobierno es responsable de crear un Comit\u00e9 de Evaluaci\u00f3n que eval\u00fae los riesgos de las sustancias y recomiende medidas de gesti\u00f3n de riesgos.<\/li><\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e849258 elementor-widget elementor-widget-text-editor\" data-id=\"e849258\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>El proyecto de ley, Proyecto 6120\/2019, se aplica a las sustancias qu\u00edmicas industriales como tales, en mezclas o en art\u00edculos en vol\u00famenes superiores a 1 TPA. Seg\u00fan el art\u00edculo 3 del proyecto de ley, las siguientes sustancias qu\u00edmicas quedan fuera del \u00e1mbito de aplicaci\u00f3n, ya que est\u00e1n reguladas por otras leyes y reglamentos espec\u00edficos:<\/p><ul><li>Pesticidas<\/li><li>Productos farmac\u00e9uticos y gases medicinales<\/li><li>Cosm\u00e9ticos, art\u00edculos de tocador y perfumes<\/li><li>Desinfectantes<\/li><li>Productos de uso veterinario<\/li><li>Alimentos y aditivos alimentarios<\/li><li>Productos utilizados para la alimentaci\u00f3n animal<\/li><li>Fertilizantes<\/li><\/ul><p>El proyecto de ley est\u00e1 pendiente en el Senado y es el \u00faltimo tr\u00e1mite para su promulgaci\u00f3n. The draft law sets provisions for the creation of a national existing chemical substance inventory and for the evaluation and control of chemical substances. The bill adopts GHS as the mandatory classification system. Data related to hazard and risk are not confidential, but substance identity can be confidential in special circumstances. Chemicals of unknown or variable composition (UVBCs) must be registered as a single chemical. Candidate substances for prioritization include Carcinogenic, Mutagenic and Reprotoxic (CMR), Persistent, Bioaccumulative, and Toxic (PBT) and Endocrine Disruptors. In addition substances that are covered by international agreements or conventions can also be prioritized. Manufacturers, exporters, and importers of chemical substances are obliged to provide information to the National Inventory of Chemical Substances. Animal testing should be the last resort to determine the hazard of a chemical. Non-compliance of the law is subject to administrative sanctions. The government is responsible for setting up an Assessment Committee to assess the risks of the substances and recommend risk management measures. The draft law, Bill 6120\/2019, applies to industrial chemical substances on their own, in mixtures or in articles in volumes above 1 TPA.
