El Decreto 57 establece los criterios y obligaciones que deben cumplir los fabricantes e importadores de sustancias peligrosas para introducir o mantener sus productos en el mercado. Ejemplos de sustancias no consideradas para la aplicaci\u00f3n del Decreto 57 son las sustancias nucleares, los intermediarios, las sustancias en almacenes, las sustancias utilizadas en investigaci\u00f3n y desarrollo cient\u00edfico, los productos farmac\u00e9uticos, veterinarios y cosm\u00e9ticos, los fertilizantes, los art\u00edculos que contienen sustancias o mezclas peligrosas y los productos alimenticios.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e7c09c5 elementor-widget elementor-widget-heading\" data-id=\"e7c09c5\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">\u00bfQU\u00c9 SE CONSIDERA UNA SUSTANCIA\nPELIGROSA? <\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b3f8d67 elementor-widget elementor-widget-text-editor\" data-id=\"b3f8d67\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>En agosto de 2021, el Ministerio de Salud aprob\u00f3 una lista oficial de clasificaci\u00f3n de sustancias mediante la Resoluci\u00f3n 777. Se sabe que la lista es la referencia m\u00ednima para fabricantes e importadores a la hora de clasificar sus sustancias. Las sustancias peligrosas son aquellas que contienen las clases de peligro identificadas por la revisi\u00f3n 7 del SGA, con algunas excepciones.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f91a878 elementor-widget elementor-widget-text-editor\" data-id=\"f91a878\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Entre las categor\u00edas de peligro no consideradas en el Decreto 57 se incluyen:<\/p><ul><li>los gases inflamables (categor\u00eda 1b)<\/li><li>l\u00edquidos inflamables (categor\u00eda 4)<\/li><li>explosivos insensibilizados<\/li><li>toxicidad aguda (categor\u00eda 5)<\/li><li>irritaci\u00f3n cut\u00e1nea (categor\u00eda 3)<\/li><li>irritaci\u00f3n ocular (categor\u00eda 2b)<\/li><li>peligro de aspiraci\u00f3n (categor\u00eda 2)<\/li><\/ul><p>peligros agudos para el medio ambiente acu\u00e1tico (categor\u00edas 2 y 3)<\/p><p>La lista no es exhaustiva, y en el caso de que una sustancia qu\u00edmica no est\u00e9 presente en ella, los fabricantes e importadores deben identificar, clasificar y etiquetar las sustancias seg\u00fan su peligrosidad antes de su comercializaci\u00f3n o uso. Es conveniente utilizar los datos existentes de ensayos, centros de datos, estudios cl\u00ednicos y literatura cient\u00edfica. Si a\u00fan as\u00ed se requieren m\u00e1s pruebas, \u00e9stas deben realizarse preferiblemente seg\u00fan las directrices de la OCDE y llevarse a cabo en laboratorios certificados seg\u00fan la norma ISO 17025. Los ensayos con animales son el \u00faltimo recurso.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<section class=\"elementor-section elementor-inner-section elementor-element elementor-element-7fa30cc elementor-section-boxed elementor-section-height-default elementor-section-height-default wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no\" data-id=\"7fa30cc\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-inner-column elementor-element elementor-element-70d841e\" data-id=\"70d841e\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-2f2b52d elementor-widget elementor-widget-heading\" data-id=\"2f2b52d\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">\u00bfQUI\u00c9N DEBE NOTIFICARLO?<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bbe56c3 elementor-widget elementor-widget-text-editor\" data-id=\"bbe56c3\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Los fabricantes e importadores de sustancias clasificadas como peligrosas presentes en mezclas deber\u00e1n notificar al gobierno chileno cuando se trate de cantidades <strong>\u2265 1 tonelada al a\u00f1o<\/strong>. La informaci\u00f3n que debe facilitarse debe incluir:<\/p><p><strong>Informaci\u00f3n del notificador<\/strong><\/p><ul><li>Nombre, direcci\u00f3n, tel\u00e9fono y correo electr\u00f3nico del notificante, representante legal y persona de contacto.<\/li><li>Los fabricantes deben indicar la direcci\u00f3n de la planta de fabricaci\u00f3n.<\/li><\/ul><p><strong>Datos sobre la sustancia<\/strong><\/p><ul><li>Nombres de las sustancias (IUPAC, comercial, com\u00fan, etc.)<\/li><li>N\u00famero CAS<\/li><li>Clasificaci\u00f3n del peligro (con clase y categor\u00eda de peligro)<\/li><li>Cantidades fabricadas o importadas al a\u00f1o (expresadas en masa)<\/li><li>Usos previstos de la sustancia<\/li><li>Adjuntar la FDS de la sustancia (en espa\u00f1ol)<\/li><\/ul><p>La notificaci\u00f3n debe realizarse cada dos a\u00f1os, con fecha l\u00edmite el 30 de agosto, teniendo en cuenta lo fabricado o importado en los dos a\u00f1os naturales anteriores. Chemical Regulation Chile REACH (THE DECREE 57) WHAT IS THE DECREE 57 ABOUT? Chile enacted, on February 2021, a new regulation on the classification, labeling, and notification of hazardous substances and mixtures. Decree 57 establishes criteria and obligations that manufacturers and importers of hazardous substances must meet in order to introduce or maintain their products on the market. The new regulation was developed jointly by the Ministry of Health and the Ministry of Environment. GET IN TOUCH FOR CHILE REACH REGISTRATION WHAT IS THE SCOPE? Decree 57 applies to substances and mixtures that are not regulated by specific laws and are classified as hazardous. Examples of substances not considered for Decree 57 application are nuclear substances, intermediaries, substances in warehouses, substances used in scientific research and development, pharmaceutical, veterinary, and cosmetic products, fertilizers, articles containing dangerous substances or mixtures, and food products. WHAT IS CONSIDERED A HAZARDOUS SUBSTANCE? In August 2021, the Ministry of Health approved an official list of classification of substances by Resolution 777. The list is known to be the minimum reference for manufacturers and importers when classifying their substances. Hazard substances are those containing hazard classes identified by GHS revision 7, with some exceptions. Hazard categories not considered in Decree 57 include: the flammable gases (category 1b) flammable liquids (category 4) desensitized explosives acute toxicity (category 5) skin irritation (category 3) eye irritation (category 2b) aspiration hazard (category 2) acute hazards to the aquatic environment (categories 2 and 3) The list is not extensive, and in the case where a chemical is not present in the list, manufacturers and importers must identify, classify, and label the substances according to their hazardous status before marketing or use. It is desirable to use existing data from trials, data centers, clinical studies, and scientific literature. If further tests are still required, these should be preferably performed according to the OECD guidelines and carried out by laboratories certified according to the ISO 17025 standard. Animal tests are the last resort. WHO SHOULD NOTIFY? The manufacturers and importers of substances classified as hazardous substances present in mixtures will have to notify the Chilean government when dealing with amounts \u2265 1 ton per annum. Substances contained in mixtures only requires notification when presenting such hazardous characteristics and are over cutoff values as displayed below. WHAT INFORMATION IS REQUIRED FOR NOTIFICATION? The environmental authority is establishing an electronic portal for chemical reporting where the notifier will be able to submit all requested information. The information to be provided should include: Notifier information Name, address, phone, and email of the notifier, legal representative, and contact person. Manufacturers must indicate the address of the manufacturing plant. Data about the substance Substance names (IUPAC, commercial, common, etc.) CAS number Hazard classification (with hazard class and category) Manufactured or imported amounts per annum (expressed in mass) Substance intended uses Attach the substance SDS (in Spanish) The notification must be made every two years, with a deadline of August 30, considering what was manufactured or imported in the previous two calendar years. The first notification window is scheduled for February \u2013 August 2024. IMPLEMENTATION TIMELINE Decree 57 implementation will be gradual with several deadlines along the way.
