Les ICMSR devraient \u00eatre notifi\u00e9es \u00e0 l'OMC en 2022 et entrer en vigueur apr\u00e8s un processus d'approbation juridique et de retour d'information minist\u00e9riel.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ff363ba elementor-widget elementor-widget-heading\" data-id=\"ff363ba\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Qui est concern\u00e9 ?<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1a82fa8 elementor-widget elementor-widget-text-editor\" data-id=\"1a82fa8\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul><li><p>Les fabricants et importateurs indiens sont tenus de se conformer \u00e0 l'ICMSR, qui contient \u00e9galement certaines obligations pour les utilisateurs en aval.\u00a0<\/p><\/li><li><p>Les entit\u00e9s \u00e9trang\u00e8res qui souhaitent commercialiser des produits sur le march\u00e9 indien doivent d\u00e9signer un repr\u00e9sentant autoris\u00e9 (RA) qui agira en leur nom et se conformera aux dispositions de l'ICMSR.<\/p><\/li><li><p>La notification est requise pour toutes les substances dont la quantit\u00e9 est sup\u00e9rieure \u00e0 1 tonne par an (TPA). Le projet actuel pr\u00e9voit une p\u00e9riode de notification initiale de 180 jours, \u00e0 compter de l'entr\u00e9e en vigueur de l'ICMSR. Les substances notifi\u00e9es pendant la p\u00e9riode de notification initiale seront consid\u00e9r\u00e9es comme des substances existantes.\u00a0<\/p><p>Les substances qui n'ont pas \u00e9t\u00e9 notifi\u00e9es au cours de l'INP seront consid\u00e9r\u00e9es comme des substances nouvelles. Si elles sont plac\u00e9es sur le march\u00e9 indien en quantit\u00e9s sup\u00e9rieures \u00e0 1 TPA, elles doivent \u00eatre notifi\u00e9es au moins 60 jours avant d'\u00eatre plac\u00e9es sur le territoire indien.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ddf09c4 elementor-widget elementor-widget-heading\" data-id=\"ddf09c4\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Inscription<\/h4>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f223b40 elementor-widget elementor-widget-text-editor\" data-id=\"f223b40\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Outre la notification, certaines substances devront \u00eatre enregistr\u00e9es si elles sont plac\u00e9es sur le territoire indien en quantit\u00e9s sup\u00e9rieures \u00e0 1 TPA. Ces substances devront \u00e9galement \u00eatre enregistr\u00e9es si elles sont pr\u00e9sentes dans des articles dont elles sont destin\u00e9es ou susceptibles d'\u00eatre rejet\u00e9es en quantit\u00e9s sup\u00e9rieures \u00e0 1 tonne par producteur ou importateur et par an.\u00a0<\/p><p>L'ICMSR adopte une approche de liste pour l'enregistrement. Toutes les substances inscrites \u00e0 l'annexe II doivent \u00eatre enregistr\u00e9es dans les 18 mois suivant leur inscription \u00e0 l'annexe.\u00a0<\/p><p>Les interm\u00e9diaires - substances fabriqu\u00e9es, consomm\u00e9es ou utilis\u00e9es dans un processus chimique pour \u00eatre transform\u00e9es en d'autres substances - sont \u00e9galement soumis \u00e0 des obligations d'enregistrement, qui varient en fonction de leur quantit\u00e9 et du fait qu'ils sont stock\u00e9s ou transport\u00e9s.\u00a0<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f914748 elementor-widget elementor-widget-heading\" data-id=\"f914748\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Rapports<\/h4>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b3f8d67 elementor-widget elementor-widget-text-editor\" data-id=\"b3f8d67\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul><li><p>Les informations soumises au moment de la notification et de l'enregistrement doivent \u00eatre r\u00e9guli\u00e8rement mises \u00e0 jour.\u00a0<\/p><\/li><li><p>Un rapport annuel doit \u00eatre \u00e9tabli pour toutes les substances notifi\u00e9es au cours des 60 premiers jours de l'ann\u00e9e civile. Ce rapport doit inclure toute modification des informations soumises au moment de la notification, ainsi que la quantit\u00e9 r\u00e9elle de substances plac\u00e9es sur le territoire indien (y compris toute modification de la redevance applicable).\u00a0<\/p><\/li><li><p>Les modifications apport\u00e9es aux informations soumises lors de l'enregistrement doivent \u00eatre notifi\u00e9es, si elles ont une incidence sur la gestion des dangers ou des risques, dans les 60 jours suivant la date \u00e0 laquelle le responsable de l'enregistrement a pris connaissance de ces
