Cependant, aucune loi ne s'applique aux produits chimiques industriels. En octobre 2018, la Commission nationale de s\u00e9curit\u00e9 des produits chimiques\u00a0<a href=\"https:\/\/conselhos.cut.org.br\/conselhos\/comissao-nacional-de-seguranca-quimica\/\" target=\"_blanck\" rel=\"noopener\">(Comit\u00ea Nacional Sobre Seguran\u00e7a Qu\u00edmica, ou CONASQ),\u00a0<\/a>a publi\u00e9, en collaboration avec le minist\u00e8re de l'environnement (Minist\u00e9rio do Meio Ambiente, ou MME), un avant-projet de loi sur l'inventaire, l'\u00e9valuation et le contr\u00f4le des substances chimiques.<\/p><p>Le projet de loi pr\u00e9voit des dispositions pour la cr\u00e9ation d'un inventaire national des substances chimiques existantes et pour l'\u00e9valuation et le contr\u00f4le des substances chimiques. Le projet de loi 6120\/2019 exigerait que les fabricants, les exportateurs et les importateurs de produits chimiques d\u00e9clarent le volume de substances chimiques produites et import\u00e9es chaque ann\u00e9e. En outre, les fiches de donn\u00e9es de s\u00e9curit\u00e9 (FDS) devront \u00eatre pr\u00e9par\u00e9es conform\u00e9ment au SGH, y compris les utilisations recommand\u00e9es, les classifications des dangers et les \u00e9tudes d'analyse d'\u00e9valuation des risques chimiques pour les utilisations recommand\u00e9es. Le projet de loi a \u00e9t\u00e9 approuv\u00e9 par la Commission du d\u00e9veloppement \u00e9conomique, de l'industrie, du commerce et des services commerciaux (CDEICS) le 23 novembre 2022. La mesure est actuellement examin\u00e9e par la Commission de la Constitution, de la Justice et de la Citoyennet\u00e9 (CCJC). \u00a0<\/span><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5a56437 elementor-widget elementor-widget-text-editor\" data-id=\"5a56437\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Les aspects les plus importants du projet de loi 6120\/2019 sont les suivants :<\/p><ul><li>Les exigences en mati\u00e8re de donn\u00e9es de notification comprennent l'identit\u00e9 de la substance, le num\u00e9ro CAS, les utilisations recommand\u00e9es, la fiche de donn\u00e9es de s\u00e9curit\u00e9, les informations relatives \u00e0 la classification et l'analyse de l'\u00e9valuation des risques pour toutes les substances de l'inventaire.<\/li><li>Le projet de loi adopte le SGH comme syst\u00e8me de classification obligatoire.<\/li><li>Les donn\u00e9es relatives aux dangers et aux risques ne sont pas confidentielles, mais l'identit\u00e9 des substances peut l'\u00eatre dans des circonstances particuli\u00e8res.<\/li><li>Les produits chimiques de composition inconnue ou variable (UVBC) doivent \u00eatre enregistr\u00e9s comme un seul produit chimique.<\/li><li>Les substances candidates \u00e0 l'\u00e9tablissement d'un ordre de priorit\u00e9 comprennent les substances canc\u00e9rog\u00e8nes, mutag\u00e8nes et toxiques pour la reproduction (CMR), les substances persistantes, bioaccumulables et toxiques (PBT) et les perturbateurs endocriniens. En outre, les substances couvertes par des accords ou conventions internationaux peuvent \u00e9galement \u00eatre class\u00e9es par ordre de priorit\u00e9.<\/li><li>Les fabricants, les exportateurs et les importateurs de substances chimiques sont tenus de fournir des informations \u00e0 l'inventaire national des substances chimiques.<\/li><li>L'exp\u00e9rimentation animale doit \u00eatre le dernier recours pour d\u00e9terminer le danger d'un produit chimique.<\/li><li>Le non-respect de la loi est passible de sanctions administratives.<\/li><li>Le gouvernement est charg\u00e9 de mettre en place un comit\u00e9 d'\u00e9valuation charg\u00e9 d'\u00e9valuer les risques des substances et de recommander des mesures de gestion des risques.<\/li><\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e849258 elementor-widget elementor-widget-text-editor\" data-id=\"e849258\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Le projet de loi 6120\/2019 s'applique aux substances chimiques industrielles en tant que telles, dans des m\u00e9langes ou dans des articles dans des volumes sup\u00e9rieurs \u00e0 1 TPA. Selon l'article 3 du projet de loi, les substances chimiques suivantes sont hors champ d'application car elles sont r\u00e9gies par d'autres lois et r\u00e8glements sp\u00e9cifiques :<\/p><ul><li>Pesticides<\/li><li>Produits pharmaceutiques et gaz m\u00e9dicaux<\/li><li>Cosm\u00e9tiques, produits de toilette et parfums<\/li><li>D\u00e9sinfectants<\/li><li>Produits \u00e0 usage v\u00e9t\u00e9rinaire<\/li><li>Aliments et additifs alimentaires<\/li><li>Produits utilis\u00e9s pour l'alimentation animale<\/li><li>Engrais<\/li><\/ul><p>Le projet de loi est en cours d'examen par le S\u00e9nat et il s'agit de la derni\u00e8re \u00e9tape avant sa promulgation. Animal testing should be the last resort to determine the hazard of a chemical. Non-compliance of the law is subject to administrative sanctions. The government is responsible for setting up an Assessment Committee to assess the risks of the substances and recommend risk management measures.
