Le d\u00e9cret 57 \u00e9tablit les crit\u00e8res et les obligations que les fabricants et les importateurs de substances dangereuses doivent respecter pour introduire ou maintenir leurs produits sur le march\u00e9. Les substances nucl\u00e9aires, les interm\u00e9diaires, les substances stock\u00e9es, les substances utilis\u00e9es dans la recherche scientifique et le d\u00e9veloppement, les produits pharmaceutiques, v\u00e9t\u00e9rinaires et cosm\u00e9tiques, les engrais, les articles contenant des substances ou des m\u00e9langes dangereux et les produits alimentaires sont autant d'exemples de substances qui ne sont pas concern\u00e9es par l'application du d\u00e9cret 57.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e7c09c5 elementor-widget elementor-widget-heading\" data-id=\"e7c09c5\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">QU'EST-CE QUI EST CONSID\u00c9R\u00c9 COMME UNE\nDANGEREUSE ? <\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b3f8d67 elementor-widget elementor-widget-text-editor\" data-id=\"b3f8d67\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>En ao\u00fbt 2021, le minist\u00e8re de la sant\u00e9 a approuv\u00e9 une liste officielle de classification des substances par la r\u00e9solution 777. Cette liste est consid\u00e9r\u00e9e comme la r\u00e9f\u00e9rence minimale pour les fabricants et les importateurs lors de la classification de leurs substances. Les substances dangereuses sont celles qui contiennent des classes de danger identifi\u00e9es par la r\u00e9vision 7 du SGH, \u00e0 quelques exceptions pr\u00e8s.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f91a878 elementor-widget elementor-widget-text-editor\" data-id=\"f91a878\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Les cat\u00e9gories de risques non prises en compte dans le d\u00e9cret 57 sont les suivantes<\/p><ul><li>les gaz inflammables (cat\u00e9gorie 1b)<\/li><li>liquides inflammables (cat\u00e9gorie 4)<\/li><li>explosifs d\u00e9sensibilis\u00e9s<\/li><li>toxicit\u00e9 aigu\u00eb (cat\u00e9gorie 5)<\/li><li>irritation de la peau (cat\u00e9gorie 3)<\/li><li>irritation des yeux (cat\u00e9gorie 2b)<\/li><li>risque d'aspiration (cat\u00e9gorie 2)<\/li><\/ul><p>dangers aigus pour l'environnement aquatique (cat\u00e9gories 2 et 3)<\/p><p>La liste n'est pas exhaustive et, dans le cas o\u00f9 un produit chimique ne figure pas dans la liste, les fabricants et les importateurs doivent identifier, classer et \u00e9tiqueter les substances en fonction de leur statut de danger avant de les commercialiser ou de les utiliser. Il est souhaitable d'utiliser les donn\u00e9es existantes provenant d'essais, de centres de donn\u00e9es, d'\u00e9tudes cliniques et de la litt\u00e9rature scientifique. Si des tests suppl\u00e9mentaires sont encore n\u00e9cessaires, ils doivent \u00eatre effectu\u00e9s de pr\u00e9f\u00e9rence conform\u00e9ment aux lignes directrices de l'OCDE et r\u00e9alis\u00e9s par des laboratoires certifi\u00e9s selon la norme ISO 17025. Les informations \u00e0 fournir sont les suivantes<\/p><p><strong>Informations sur le notificateur<\/strong><\/p><ul><li>Nom, adresse, t\u00e9l\u00e9phone et adresse \u00e9lectronique du notifiant, du repr\u00e9sentant l\u00e9gal et de la personne de contact.<\/li><li>Les fabricants doivent indiquer l'adresse de l'usine de fabrication.<\/li><\/ul><p><strong>Donn\u00e9es sur la substance<\/strong><\/p><ul><li>Noms des substances (IUPAC, commercial, commun, etc.)<\/li><li>Num\u00e9ro CAS<\/li><li>Classification des dangers (avec classe et cat\u00e9gorie de danger)<\/li><li>Quantit\u00e9s fabriqu\u00e9es ou import\u00e9es par an (exprim\u00e9es en masse)<\/li><li>Utilisation pr\u00e9vue de la substance<\/li><li>Joindre la FDS de la substance (en espagnol)<\/li><\/ul><p>La notification doit \u00eatre faite tous les deux ans, avec une date limite fix\u00e9e au 30 ao\u00fbt, en tenant compte de ce qui a \u00e9t\u00e9 fabriqu\u00e9 ou import\u00e9 au cours des deux ann\u00e9es civiles pr\u00e9c\u00e9dentes. Chemical Regulation Chile REACH (THE DECREE 57) WHAT IS THE DECREE 57 ABOUT? Chile enacted, on February 2021, a new regulation on the classification, labeling, and notification of hazardous substances and mixtures. Decree 57 establishes criteria and obligations that manufacturers and importers of hazardous substances must meet in order to introduce or maintain their products on the market. The new regulation was developed jointly by the Ministry of Health and the Ministry of Environment. GET IN TOUCH FOR CHILE REACH REGISTRATION WHAT IS THE SCOPE? Decree 57 applies to substances and mixtures that are not regulated by specific laws and are classified as hazardous. Examples of substances not considered for Decree 57 application are nuclear substances, intermediaries, substances in warehouses, substances used in scientific research and development, pharmaceutical, veterinary, and cosmetic products, fertilizers, articles containing dangerous substances or mixtures, and food products. WHAT IS CONSIDERED A HAZARDOUS SUBSTANCE? In August 2021, the Ministry of Health approved an official list of classification of substances by Resolution 777. The list is known to be the minimum reference for manufacturers and importers when classifying their substances. Hazard substances are those containing hazard classes identified by GHS revision 7, with some exceptions. Hazard categories not considered in Decree 57 include: the flammable gases (category 1b) flammable liquids (category 4) desensitized explosives acute toxicity (category 5) skin irritation (category 3) eye irritation (category 2b) aspiration hazard (category 2) acute hazards to the aquatic environment (categories 2 and 3) The list is not extensive, and in the case where a chemical is not present in the list, manufacturers and importers must identify, classify, and label the substances according to their hazardous status before marketing or use. It is desirable to use existing data from trials, data centers, clinical studies, and scientific literature. If further tests are still required, these should be preferably performed according to the OECD guidelines and carried out by laboratories certified according to the ISO 17025 standard. Animal tests are the last resort. WHO SHOULD NOTIFY? The manufacturers and importers of substances classified as hazardous substances present in mixtures will have to notify the Chilean government when dealing with amounts \u2265 1 ton per annum. Substances contained in mixtures only requires notification when presenting such hazardous characteristics and are over cutoff values as displayed below. WHAT INFORMATION IS REQUIRED FOR NOTIFICATION? The environmental authority is establishing an electronic portal for chemical reporting where the notifier will be able to submit all requested information. The information to be provided should include: Notifier information Name, address, phone, and email of the notifier, legal representative, and contact person. Manufacturers must indicate the address of the manufacturing plant. Data about the substance Substance names (IUPAC, commercial, common, etc.) CAS number Hazard classification (with hazard class and category) Manufactured or imported amounts per annum (expressed in mass) Substance intended uses Attach the substance SDS (in Spanish) The notification must be made every two years, with a deadline of August 30, considering what was manufactured or imported in the previous two calendar years. The first notification window is scheduled for February \u2013 August 2024. IMPLEMENTATION TIMELINE Decree 57 implementation will be gradual with several deadlines along the way.
