Tuttavia, non esiste una legge applicabile ai prodotti chimici industriali. Nell'ottobre 2018, la Commissione Nazionale per la Sicurezza dei Prodotti Chimici\u00a0<a href=\"https:\/\/conselhos.cut.org.br\/conselhos\/comissao-nacional-de-seguranca-quimica\/\" target=\"_blanck\" rel=\"noopener\">(Comit\u00ea Nacional Sobre Seguran\u00e7a Qu\u00edmica, o CONASQ),\u00a0<\/a>insieme al Ministero dell'Ambiente (Minist\u00e9rio do Meio Ambiente, o MME), ha pubblicato un progetto di legge preliminare per l'inventario, la valutazione e il controllo delle sostanze chimiche.<\/p><p>Il progetto di legge prevede disposizioni per la creazione di un inventario nazionale delle sostanze chimiche esistenti e per la valutazione e il controllo delle sostanze chimiche. Il disegno di legge 6120\/2019 prevede che i produttori, gli esportatori e gli importatori di sostanze chimiche debbano comunicare il volume di sostanze chimiche prodotte e importate annualmente. Inoltre, le schede di sicurezza (SDS) dovranno essere redatte in conformit\u00e0 al GHS, compresi gli usi raccomandati, le classificazioni dei pericoli e gli studi di valutazione del rischio chimico per gli usi raccomandati. Il progetto di legge \u00e8 stato approvato dal Comitato per lo sviluppo economico, l'industria, il commercio e i servizi commerciali (CDEICS) il 23 novembre 2022. Ora il provvedimento \u00e8 all'esame della Commissione per la Costituzione, la Giustizia e la Cittadinanza (CCJC). \u00a0<\/span><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5a56437 elementor-widget elementor-widget-text-editor\" data-id=\"5a56437\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Gli aspetti pi\u00f9 importanti del disegno di legge 6120\/2019 sono:<\/p><ul><li>I requisiti per la notifica includono l'identit\u00e0 della sostanza, il numero CAS, gli usi raccomandati, la scheda di sicurezza, le informazioni sulla classificazione e l'analisi della valutazione dei rischi per tutte le sostanze presenti nell'Inventario.<\/li><li>Il disegno di legge adotta il GHS come sistema di classificazione obbligatorio.<\/li><li>I dati relativi ai pericoli e ai rischi non sono riservati, ma l'identit\u00e0 della sostanza pu\u00f2 essere riservata in circostanze particolari.<\/li><li>Le sostanze chimiche di composizione sconosciuta o variabile (UVBC) devono essere registrate come una singola sostanza chimica.<\/li><li>Le sostanze candidate per la definizione delle priorit\u00e0 includono sostanze cancerogene, mutagene e reprotossiche (CMR), persistenti, bioaccumulabili e tossiche (PBT) e interferenti endocrini. Inoltre, possono essere classificate come prioritarie anche le sostanze coperte da accordi o convenzioni internazionali.<\/li><li>I produttori, gli esportatori e gli importatori di sostanze chimiche sono tenuti a fornire informazioni all'Inventario nazionale delle sostanze chimiche.<\/li><li>La sperimentazione animale dovrebbe essere l'ultima risorsa per determinare la pericolosit\u00e0 di una sostanza chimica.<\/li><li>Il mancato rispetto della legge \u00e8 soggetto a sanzioni amministrative.<\/li><li>Il governo ha la responsabilit\u00e0 di istituire un Comitato di valutazione per valutare i rischi delle sostanze e raccomandare misure di gestione dei rischi.<\/li><\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e849258 elementor-widget elementor-widget-text-editor\" data-id=\"e849258\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Il progetto di legge, disegno di legge 6120\/2019, si applica alle sostanze chimiche industriali da sole, in miscele o in articoli in volumi superiori a 1 TPA. Secondo l'articolo 3 del disegno di legge, le seguenti sostanze chimiche sono fuori dal campo di applicazione in quanto regolate da altre leggi e regolamenti specifici:<\/p><ul><li>Pesticidi<\/li><li>Prodotti farmaceutici e gas medicali<\/li><li>Cosmetici, articoli da toilette e profumi<\/li><li>Disinfettanti<\/li><li>Prodotti per uso veterinario<\/li><li>Alimenti e additivi alimentari<\/li><li>Prodotti utilizzati per l'alimentazione animale<\/li><li>Fertilizzanti<\/li><\/ul><p>Il disegno di legge \u00e8 in attesa di essere approvato dal Senato ed \u00e8 in dirittura d'arrivo. Chemicals of unknown or variable composition (UVBCs) must be registered as a single chemical. Candidate substances for prioritization include Carcinogenic, Mutagenic and Reprotoxic (CMR), Persistent, Bioaccumulative, and Toxic (PBT) and Endocrine Disruptors. In addition substances that are covered by international agreements or conventions can also be prioritized. Manufacturers, exporters, and importers of chemical substances are obliged to provide information to the National Inventory of Chemical Substances. Animal testing should be the last resort to determine the hazard of a chemical. Non-compliance of the law is subject to administrative sanctions. The government is responsible for setting up an Assessment Committee to assess the risks of the substances and recommend risk management measures. The draft law, Bill 6120\/2019, applies to industrial chemical substances on their own, in mixtures or in articles in volumes above 1 TPA.
