Che cos'è l'AICIS (Australian Industrial Chemicals Introduction Scheme)?
L'Industrial Chemicals Act 2019 ha istituito l'Australian Industrial Chemicals Introduction Scheme (AICIS) per regolare l'importazione e la produzione (introduzione) di prodotti chimici industriali in Australia.
L'AICIS ha sostituito il National Industrial Chemicals Notification and Assessment Scheme (NICNAS) il 1° luglio 2020. L'AICIS regolamenta le sostanze chimiche (compresi i polimeri) introdotte per uso industriale, come inchiostri, vernici, adesivi, solventi, cosmetici e prodotti per la cura della persona, prodotti per la pulizia, oltre che nelle applicazioni manifatturiere, edilizie e minerarie, e promuove l'uso sicuro delle sostanze chimiche industriali al fine di proteggere la salute umana e l'ambiente.
Chi è interessato?
Gli importatori e i produttori (introduttori) di sostanze chimiche industriali per scopi commerciali devono registrare la propria attività nell'ambito di questo schema. Tutti gli introduttori di sostanze chimiche industriali devono classificare la loro importazione o produzione di sostanze chimiche (introduzione) nelle seguenti categorie: introduzione elencata, introduzione esente, introduzione segnalata, introduzione valutata, valutazione commerciale prima di immetterla nel territorio australiano.
Se l'introduzione è elencata nell'Inventario australiano delle sostanze chimiche industriali (l'Inventario), allora è classificata come introduzione elencata e può essere immessa sul mercato nel rispetto degli obblighi normativi (se esistenti). Se l'introduzione non rientra nella categoria elencata, deve essere autorizzata in una delle altre categorie.
Dichiarazione annuale
Indipendentemente dalla categoria di introduzione, è necessario presentare una dichiarazione annuale alla fine di ogni anno di registrazione (tra il 1° agosto e il 30 novembre). Questa dichiarazione deve indicare le sostanze chimiche industriali importate o prodotte nell'anno di registrazione precedente e conferma che le introduzioni sono state autorizzate secondo le leggi australiane.
Categorie di introduzione per i prodotti chimici
Gli importatori e i produttori (introduttori) di sostanze chimiche industriali per scopi commerciali devono registrare la propria attività nell'ambito di questo schema. Tutti gli introduttori di sostanze chimiche industriali devono classificare la loro importazione o produzione di sostanze chimiche (introduzione) nelle seguenti categorie: introduzione elencata, introduzione esente, introduzione segnalata, introduzione valutata, valutazione commerciale prima di immetterla nel territorio australiano.
Se l'introduzione è elencata nell'Inventario australiano delle sostanze chimiche industriali (l'Inventario), è classificata come Introduzione elencatae può essere immessa sul mercato rispettando gli eventuali obblighi normativi. Se l'introduzione non rientra nella categoria elencata, deve essere autorizzata in una delle altre categorie.
È importante che gli introducer non australiani registrino la propria attività e soddisfino i requisiti di conformità e rendicontazione per poter esportare senza interruzioni in Australia. A tale scopo è obbligatorio l'Australian Registered Business Number (ARBN). Gli introducer non australiani possono anche nominare un agente australiano per i requisiti di conformità se non sono in grado di ottenere l'Australian Registered Business Number (ARBN).

Documentation & Recordkeeping Under AICIS
All introducers (importers and manufacturers) of industrial chemicals must ensure compliance with the requirements of the Australian Industrial Chemicals Introduction Scheme (AICIS). To ensure compliance all introducers must keep records and documentation for all industrial chemical(s) introduced by them for a minimum period of 5 years.
- Identity Records for the Chemical – e.g. molecular formula, CAS registry number, chemical name.
- Safety Data Sheets (SDS) for the introduced chemical(s) – These must be able to be accessed by the introducer and made available to the end user as required by the Code for the Manufacture of Industrial Chemicals (CMIC).
- A description of the risk assessment information used to identify health and environmental hazards of the industrial chemical present and the effects that they have on human health and the environment.
- The volume at which you import/ manufacture a chemical – used to calculate the registration level and AICIS fees that you pay.
- Exposure scenarios: information describing how the introduced chemical is used and managed, how it is handled and how it should be disposed of.
- Introduction category justification: The justification for introducing a chemical under a particular introduction category (listed, exempted, reported, assessed or commercial evaluation).
- Records that provide evidence of calculation of declared volumes of introduced industrial chemicals (e.g. commercial invoices; orders; airway bills; receipts).
Note that AICIS may require documentation to be provided within 20 working days. All documentation for a chemical must be retained for a minimum of 5 years after use for introduced industrial chemicals whether or not the chemical is still being introduced.
