Qu'est-ce que l'AICIS (Australian Industrial Chemicals Introduction Scheme) ?
La loi de 2019 sur les produits chimiques industriels a établi le système australien d'introduction des produits chimiques industriels (AICIS) pour réglementer l'importation et la fabrication (introduction) des produits chimiques industriels en Australie.
L'AICIS a remplacé le système national de notification et d'évaluation des produits chimiques industriels (NICNAS) le 1er juillet 2020. L'AICIS réglemente les produits chimiques (y compris les polymères) introduits pour un usage industriel, comme dans les encres, les peintures, les adhésifs, les solvants, les cosmétiques et les produits de soins personnels, les produits de nettoyage, ainsi que dans les applications de fabrication, de construction et d'exploitation minière, et vise à promouvoir l'utilisation sûre des produits chimiques industriels afin de protéger la santé humaine et l'environnement.
Qui est concerné ?
Les importateurs et les fabricants (introducteurs) de produits chimiques industriels à des fins commerciales doivent enregistrer leur activité dans le cadre de ce système. Tous les introducteurs de produits chimiques industriels doivent classer leur importation ou leur fabrication (introduction) dans les catégories suivantes : introduction répertoriée, introduction exemptée, introduction déclarée, introduction évaluée, évaluation commerciale, avant d'être introduits sur le territoire australien.
Si l'introduction figure dans l'inventaire australien des produits chimiques industriels (l'inventaire), elle est classée dans la catégorie des introductions répertoriées et peut être mise sur le marché en respectant les obligations réglementaires (le cas échéant). Si l'introduction n'appartient pas à la catégorie listée, elle doit être autorisée dans l'une des autres catégories.
Déclaration annuelle
Quelle que soit la catégorie d'introduction, une déclaration annuelle doit être soumise à la fin de chaque année d'enregistrement (entre le 1er août et le 30 novembre). Cette déclaration concerne les produits chimiques industriels importés ou fabriqués au cours de l'année d'enregistrement précédente et confirme que les introductions ont été autorisées par la législation australienne.
Catégories d'introduction pour les produits chimiques
Les importateurs et les fabricants (introducteurs) de produits chimiques industriels à des fins commerciales doivent enregistrer leur activité dans le cadre de ce système. Tous les introducteurs de produits chimiques industriels doivent classer leur importation ou leur fabrication (introduction) dans les catégories suivantes : introduction répertoriée, introduction exemptée, introduction déclarée, introduction évaluée, évaluation commerciale, avant d'être introduits sur le territoire australien.
Si l'introduction est répertoriée dans l'inventaire australien des produits chimiques industriels (l'inventaire), elle est classée comme suit Introduction à la listeet peut être mise sur le marché en respectant les obligations réglementaires (le cas échéant). Si l'introduction ne fait pas partie de la catégorie listée, elle doit être autorisée dans l'une des autres catégories.
Il est important que les introducteurs non australiens enregistrent leur entreprise et respectent les exigences en matière de conformité et de déclaration afin d'assurer la continuité des exportations vers l'Australie. Le numéro d'entreprise australien (Australian Registered Business Number - ARBN) est obligatoire à cet effet. Les introducteurs non australiens peuvent également désigner un agent australien pour répondre aux exigences de conformité s'ils ne sont pas en mesure d'obtenir l'Australian Registered Business Number (ARBN).

Documentation & Recordkeeping Under AICIS
All introducers (importers and manufacturers) of industrial chemicals must ensure compliance with the requirements of the Australian Industrial Chemicals Introduction Scheme (AICIS). To ensure compliance all introducers must keep records and documentation for all industrial chemical(s) introduced by them for a minimum period of 5 years.
- Identity Records for the Chemical – e.g. molecular formula, CAS registry number, chemical name.
- Safety Data Sheets (SDS) for the introduced chemical(s) – These must be able to be accessed by the introducer and made available to the end user as required by the Code for the Manufacture of Industrial Chemicals (CMIC).
- A description of the risk assessment information used to identify health and environmental hazards of the industrial chemical present and the effects that they have on human health and the environment.
- The volume at which you import/ manufacture a chemical – used to calculate the registration level and AICIS fees that you pay.
- Exposure scenarios: information describing how the introduced chemical is used and managed, how it is handled and how it should be disposed of.
- Introduction category justification: The justification for introducing a chemical under a particular introduction category (listed, exempted, reported, assessed or commercial evaluation).
- Records that provide evidence of calculation of declared volumes of introduced industrial chemicals (e.g. commercial invoices; orders; airway bills; receipts).
Note that AICIS may require documentation to be provided within 20 working days. All documentation for a chemical must be retained for a minimum of 5 years after use for introduced industrial chemicals whether or not the chemical is still being introduced.
