AICIS(호주 산업 화학물질 도입 제도)란 무엇인가요?

2019년 산업 화학물질법(Industrial Chemicals Act 2019)은 호주 내 산업 화학물질의 수입 및 제조(도입)를 규제하기 위해 호주 산업 화학물질 도입 제도(AICIS)를 제정했습니다. 

AICIS는 2020년 7월 1일부로 국가 산업 화학물질 신고 및 평가 제도(NICNAS)를 대체했습니다. AICIS는 잉크, 페인트, 접착제, 용제, 화장품 및 개인 위생용품, 청소 제품, 제조, 건설, 광업 등 산업용으로 도입되는 화학물질(폴리머 포함)을 규제하고 인간의 건강과 환경을 보호하기 위해 산업 화학물질의 안전한 사용을 촉진하기 위한 제도입니다.

누가 영향을 받나요?

상업적 목적의 산업용 화학물질 수입업체 및 제조업체(도입업체)는 이 제도에 따라 사업을 등록해야 합니다. 모든 산업용 화학물질 도입자는 호주 영토에 배치하기 전에 화학물질 수입 또는 제조(도입)를 다음 범주, 즉 목록 도입, 면제된 도입, 보고된 도입, 평가된 도입, 상업적 평가로 분류해야 합니다.

도입 물질이 호주 산업 화학물질 목록(이하 목록)에 등재된 경우, 해당 물질은 등재된 도입 물질로 분류되며 규제 의무(있는 경우)를 준수하여 시장에 출시할 수 있습니다. 목록에 등재된 범주에 속하지 않는 도입품은 다른 범주 중 하나로 승인을 받아야 합니다.

연례 선언문

도입 범주에 관계없이 매년 등록 연도 말(8월 1일~11월 30일 사이)에 연간 신고서를 제출해야 합니다. 이 신고는 이전 등록 연도에 수입 또는 제조한 산업용 화학물질에 대해 작성하는 것으로, 호주 법률에 따라 도입이 승인되었음을 확인하는 것입니다.

화학물질 소개 카테고리

상업적 목적의 산업용 화학물질 수입업체 및 제조업체(도입업체)는 이 제도에 따라 사업을 등록해야 합니다. 모든 산업용 화학물질 도입자는 호주 영토에 배치하기 전에 화학물질 수입 또는 제조(도입)를 다음 범주, 즉 목록 도입, 면제된 도입, 보고된 도입, 평가된 도입, 상업적 평가로 분류해야 합니다.

해당 물질이 호주 산업 화학물질 인벤토리(이하 인벤토리)에 등재된 경우 다음과 같이 분류됩니다. 상장 소개에 따라 규제 의무(있는 경우)를 준수하여 시장에 출시할 수 있습니다. 소개가 나열된 카테고리에 속하지 않는 경우 다른 카테고리 중 하나로 승인을 받아야 합니다.

AICIS

비호주 소개자는 호주로의 중단 없는 수출을 위해 사업체를 등록하고 규정 준수 및 보고 요건을 충족하는 것이 중요합니다. 이를 위해서는 호주 등록 사업자 번호(ARBN)가 필수입니다. 비호주 소개자는 호주 등록 사업자 번호(ARBN)를 취득할 수 없는 경우 호주 대리인을 지정하여 규정 준수 요건을 충족할 수도 있습니다.

Documentation & Recordkeeping Under AICIS

All introducers (importers and manufacturers) of industrial chemicals must ensure compliance with the requirements of the Australian Industrial Chemicals Introduction Scheme (AICIS). To ensure compliance all introducers must keep records and documentation for all industrial chemical(s) introduced by them for a minimum period of 5 years.

  • Identity Records for the Chemical – e.g. molecular formula, CAS registry number, chemical name.
  • Safety Data Sheets (SDS) for the introduced chemical(s) – These must be able to be accessed by the introducer and made available to the end user as required by the Code for the Manufacture of Industrial Chemicals (CMIC).
  • A description of the risk assessment information used to identify health and environmental hazards of the industrial chemical present and the effects that they have on human health and the environment.
  • The volume at which you import/ manufacture a chemical – used to calculate the registration level and AICIS fees that you pay.
  • Exposure scenarios: information describing how the introduced chemical is used and managed, how it is handled and how it should be disposed of.
  • Introduction category justification: The justification for introducing a chemical under a particular introduction category (listed, exempted, reported, assessed or commercial evaluation).
  • Records that provide evidence of calculation of declared volumes of introduced industrial chemicals (e.g. commercial invoices; orders; airway bills; receipts).

Note that AICIS may require documentation to be provided within 20 working days. All documentation for a chemical must be retained for a minimum of 5 years after use for introduced industrial chemicals whether or not the chemical is still being introduced.
